Partner Visas

Those who are in a relationship with a citizen or permanent resident of Australia, or a citizen of New Zealand can consider applying for one of the following visas:

• Spouse Visa
• Interdependency Visa
• Prospective Marriage Visa
• New Zealand Family Relationship

Spouse Visa

This visa is an option if you are married to, or have been living in a de facto relationship (living together as husband and wife without being legally married, for a minimum period of 12 months) with an Australian citizen, Australian permanent resident or what is termed an “eligible New Zealand citizen.”

Interdependency Visa

This visa is an option if you have been living in a de facto relationship for a minimum period of 12 months with a person of the same sex who is an Australian citizen, Australian permanent resident or what is termed an “eligible New Zealand citizen.”

Prospective Marriage Visa

Also known as a fiancé visa, the main requirement is that you intend to marry an Australian citizen, Australian permanent resident or an “eligible New Zealand citizen” in Australia within 9 months of being granted the visa. This is a temporary visa, and is the precursor to an application for a Spouse visa once married.

New Zealand Family Relationship

This visa is an option if you are married to, or have been living in a de facto relationship (living together as husband and wife without being legally married, for a minimum period of 12 months) with a person who is a New Zealand citizen, but is not an “eligible New Zealand citizen.” This is a long term temporary residency visa, allowing the visaholder to live and work in Australia for 5 years, and is capable of being renewed.

In broad terms, an“eligible New Zealand citizen” is an individual who was in Australia as the holder of a Special Category visa on 26th February, 2001.
